With a background of service in the U.S. Navy, federal prosecutor in the U.S. Attorney's Office in Los Angeles and trial judge in Orange County for more than 20 years, no one is more concerned about the security of our great country than I am. However, what makes this country great are our values and our liberty, and they must not be compromised! The so-called Patriot Act is a direct and frontal assault upon our civil liberties–and one that is unnecessary for our security. This statute allows the federal police, simply by administratively labeling what they are doing as a "terrorist investigation," to go into anyone's house, papers and effects, including computer systems and bank records, taking or copying whatever they want, and without even telling the person they were there—and all without a judicially-approved warrant. In addition, the information obtained can be used for any kind of prosecution whether it's related to terrorism or not. In reality, what we have is a policy of "Tap and Snoop." On December 13, 2003, the Intelligence Authorization Act expanded the reach of the seizures under the Patriot Act to include travel agencies, car dealers, casinos, hotels, real estate and insurance agencies, lawyers, pawn brokers, and even the post office. And all of these entities are precluded by law from informing anyone that this has occurred. Other provisions make criminal any act intended to influence the government through "intimidation or coercion invoking dangerous acts." That could mean that any protestors against the government could easily fall within this definition, thereby opening the door for politically-motivated prosecutions. Benjamin Franklin once said that any society that would compromise its liberty for security deserves neither. America was able to win the Cold War without sacrificing our civil liberties—and I believe our country possesses the vigor to survive the current terrorist threats as well without "destroying our civil liberties in order to save them." There actually are some provisions of the Patriot Act that are not objectionable under today's circumstances, namely the provisions that deal with the sharing of intelligence information among our various government agencies. However, the majority of the provisions of this act are truly radical, and take us a long way down the road to becoming a police state. We must actively resist these provisions! If I were to write an article on this subject it would be entitled "Where's Paul Revere?" Why is no one spreading the alarm? So make your vote count! Every vote for Judge Jim Gray for U.S. Senate will be seen as a vote to repeal the excesses of the Patriot Act. Remember, if we lose our civil liberties, the terrorists win.
